Спасибо Вам за ваше письмо от 29.09.2015. Хорошо что мы с Вами согласовались по всем пунктам Предварительного Договора кроме п. 5 и 6.

По п.5: ваше исправление счета IEE корректно и проверено. Банковские реквизиты THANH & Partners приведены в Договоре со счетом во Вьетнамских Донгах, который не может быть использован для IEE и не нужно SWIFT code. Для IEE, пожалуйста используйте наш счет в Долларах с полными реквизитами, включая SWIFT code, приведенными в наших инвойсах для IEE.

По п.6: в любом случае банковский гарантий BIDV не поможет нам быстро получить деньги от Лисемко потому что мистер Хань утверждает что как только IEE потребует плату по этому гарантию через банк, он сразу подаст иск по нарушению контракта чтобы остановить банк от платежа. Банк придется остановить платеж потому что факт нарушения Лисемком контракта не доказан и даже суд или арбитраж могут издать ордер временно остановить платеж до разрешения споров. Тем более, срок этого гарантия закончится в феврале 2016, т.е. до конца срока второго платежа по договоренности с Лисемко. Как Вам известно, Лисемко обязан отгрузить четвертую партию продукции в Марте 2016 и получит деньги за нее где-то в Апреле. Так что лучше получить деньги в худшем случае по принудительному порядку исполнения арбитражного решения. Поэтому предлагаем не осложнять и терять время на переговоры с положением по вашему предложению.
