Еще раз спасибо Вам за проделанную работу, информацию о встрече с ЛИСЕМКО и предлагаемый план действий!

Нас беспокоит график платежей, в котором как первый, так и второй предлагаемые платежи очень удалены от настоящего момента.
Насколько мы понимаем, ЛИСЕМКО получают деньги от НТПС не только по поставке. Видимо, уже получены аванс (15% всей суммы их контракта, это где то 1,7- 2,0) и самый большой платёж по первый поставке (там было 5000 тонн, и к оплате почти около 3). Они ещё что-то получат по приёмке первой партии на площадке (0,5). Т.е. к моменту второй поставки они уже получат почти 6 млн долларов.

Стремление ЛИСЕМКО растянуть платежи в нашу сторону и привязать их к графику получения денег от НТПС вполне объяснимо. Вместе с тем, велика вероятность того, что график отгрузок будет корректироваться и, скорее всего, 3-я и 4-я партии будут отгружаться позже сроков, планируемых сейчас.

Мы считаем, что если бы господин Хань, ЛИСЕМКО, проинформировал нас о графике получения средств от НТПС, это было бы с его стороны подтверждением его открытости и добросовестности по отношению к нам.

Наша задача – улучшить график платежей таким образом, чтобы мы смогли получить все наши средства до конца 2015 года. Если ЛИСЕМКО не может или не хочет начать делать платежи сейчас, платежи должны быть сделаны по получении средств от НТПС за вторую отгрузку в ноябре.


Мы предлагаем включить в соглашение с ЛИСЕМКО следующее:

1. Предусмотреть право IEE организовать через суд арест третьей/четвертой партии в случае несоблюдения компанией ЛИСЕМКО согласованного графика платежей;

2. Предусмотреть право IEE предъявить к оплате гарантию исполнения контракта 158-5 BIDV банка в случае несоблюдения компанией ЛИСЕМКО согласованного графика платежей. (Гарантия исполнения BIDV банка на USD 533.532,80 истекает 31.03.2016). Мы хотели бы привязать платежи компенсации 1,8 млн долл. (или части этой суммы) к исполнению обязательств компанией ЛИСЕМКО в рамках контракта 158-5. Тогда кроме нарушения сроков поставки у IEE будет еще один повод предъявить гарантию к оплате: нарушение сроков платежей компенсации;

Кроме того, для того, чтобы вьетнамский арбитраж признал наше соглашение с ЛИСЕМКО, предлагаю заключить доп соглашения к контрактам 158-2, 158-3 и 158-5 о замене Сингапура на Вьетнам. Иначе, как Вы писали ранее VIAC может не принять к рассмотрению наше дело. Пожалуйста, прокомментируйте.
