Спасибо Вам за быстрый ответ и мы хотели бы дать дополнительную информацию и консультации насчет соглашения с Лисемко.

1. График платежей согласованный с Лисемко является реальным и вовсе не так удален с учетом арбитражной процедуры, согласно которой мы можем получить арбитражное решение в самом лучшем случае в Ноябре-Декабре если начинаем ее сразу сейчас. А первый платеж должен быть проделан в пределах Декабря. Хань утверждает что у Лисемко план поставки в 3 партии и в этом случае вся сумма будет оплачена IEE после получения средств за вторую партию. План отгрузки в 4 партии согласован с запасом. Лисемко очень заинтересован в быстрой отгрузке для получения средств погашения его банковских долгов.
2. Всем ясно что большие деньги взятые Лисемко под кредиты банков и заложены сейчас в продукции и полуфабрикаты. Лисемко не может платить никому включая IEE из любых полученных средств пока не погасила все кредиты банка, срок возврата которых пришел или прошел.
3. Директор Хань так и открыто дал нам знать подробности ее контракта с НТПС включая цену, L/C, график поставки и получения средств от НТПС (в течение месяца после поставки очередной партии). Мы с Намом с большим давлением и трудом добились с ним фиксированный предельный график платежей: 31.12.2015 и 28.92.2016. Если Лисемко отгрузит в 3 партии, что она сейчас очень старается из за стремления скорейшего получения средств от НТПС с частичного раскрытия аккредитива, то IEE возможно получит всю сумму 1,8 млн в Декабре.
4. Как мы понимаем что Лисемко с IEE договорились закончить мирно все заключенные контракты в обмен на возврат 1,8 млн. IEE, освобождая тем самым обе партии от всех обязательств и претензий по данным контактам. Так что нам важно фиксировать обязанность Лисемко платить и получить эту сумму по согласованному графику.
5. THANH&Partners по доверенности от IEE будить заключать с Лисемко предварительный договор по платежу 1,8 млн со всеми связанными условиями включая договоренность пойти в VIAC. Этот договор будет прекратить действие после получения арбитражного решения признающее уже все его положения.
6. Для минимизации расхода, мы советуем подать в VIAC только иск по Lisemco Guarantee с суммой иска в 1,368 млн только. Так открыты все другие варианты включая банковскую гарантию, Сингапурский Арбитраж до момента получить VIAC решение.
7. VIAC решение имеет юридическую силу исполнения через судебный исполнитель без суда. Поэтому нет необходимости включить в соглашение с Лисемко ваши предложения.

PS. Сегодня по телефонному разговору с Намом и потом со мной, директор Хань утверждает что Лисемко не может поставить в 3 партии и BIDV является банком обслуживающим контракт Лисемко с НТПС. Хань утверждает что после первой партии Лисемко смогла погасить только около 40% его банковских кредитов, которые Лисемко может погасить полностью только после поставки последней партии. Так что Лисемко будет платить IEE раньше чем некоторые не очень срочные кредиты банков.
